between the company Microtech Retail Italia S.r.l. – Via Renzo e Lucia, 9 – 20142 Milano – (MI) ITALIA – VAT registration number IVA IT11722720965 and the Customer, hereafter also named “Customer” and “company MICROTECH RETAIL ITALIA” or “the Company ”.
NB: Company MICROTECH RETAIL ITALIA distinguishes between customer and consumer. The customer is in this case a private buyer, a buyer on behalf of a company or a company. The consumer is in this case a private buyer.
Introduction
MICROTECH RETAIL ITALIA is a company specialized in e-commerce of high-tech products. MICROTECH RETAIL ITALIA sells its products online, by phone, fax or mail. Each item of the “Microtech” line sold by MICROTECH RETAIL ITALIA is listed on the https://microtech.store/?lang=en. MICROTECH RETAIL ITALIA does not distribute paper catalogs.
1.0 – Subject
These General Sales Conditions aim to define the sales terms between MICROTECH RETAIL ITALIA and its customers as follows: as customer is meant any natural or legal person who places an order on microtech.store. Should these general sales conditions be different depending on the typology of customer, the differences would be openly specified.
1.1 Field of application
These General Sales Conditions govern the sale of articles on the https://microtech.store/?lang=en site from the day the order is placed. These General Sales Conditions apply whatever is the method the order was placed through: by Internet, email, phone, fax, or traditional mail. Should these general sales conditions be different depending on the typology of customer, the differences would be openly specified.
1.2 Territoriality
Customers who place an order through the MICROTECH RETAIL ITALIA website know they are buying at an Italian company and are therefore subject to Italian law. It is expressly stated that in case of litigation, a friendly solution between the parties will be preferred.
1.3 Customer’s acceptance
The order confirmation will count as acceptance of the General Sales Conditions by the Customer. These General Conditions represent the only applicable ones and replace any other condition, except for preliminary derogations in writing. The purchase through electronic mail, phone, fax or traditional mail counts as acceptance. The General Sales Conditions are available directly on the Internet site. It is possible to receive them by e-mail and fax on demand.
1.4 Modification of the General Sales Conditions
These General Sales Conditions may be changed at any time. We suggest anyway to the Customers to read the General Conditions whenever they visit the https://microtech.store/?lang=en site. Each version of these regulations refers to a specific date, so orders will be managed according to the General Sales Conditions in force on the order date.
1.5 Products features
Company MICROTECH RETAIL ITALIA try to compile in the best way the technical sheets and the essential features of the products for sale. The company MICROTECH RETAIL ITALIA pays particular attention that the images on the website actually correspond to the products being sold. However, should an aesthetic difference appear, it would have no consequences on the main technical features of the product. The products offered comply with the current European legislation and the applicable rules in Europe.
Company MICROTECH RETAIL ITALIA try to offer to the customer the manual in its own language, if the manual is needed.
1.7 Prices
1.7.1 All sales prices display on the website are expressed in Euros (€) inclusive of VAT but not of delivery costs. 1.7.2 Prices shown on the website are subject to changes at any time according to the increase in suppliers rates and launch prices, promotions, etc. Item prices may vary: anyway if the price changes compared to the price at the order date, the Customer will be informed and will be free to keep or cancel the order. 1.7.3 All prices are indicated subject to evident typing errors. 1.7.4 Shipping costs are invoiced on the basis of the parcel weight (according to the forwarder’s weight-volume rules), the country of delivery and the forwarder in charge. They include ad valorem insurance. If deliveries provide for cash payment, the service value is included in the delivery price. This value can not be disputed, if the service has been already accomplished.
1.7.5 Insurance
Company MICROTECH RETAIL ITALIA only ships packages, which have an insurance ad valorem. The insurance value is included in the shipping cost.
2.0 Value-added tax (VAT)
2.1 Application
VAT is applied to sales concluded with residents in the European Union. It is not applied to non-Italian companies of the European Union that have a VAT number within EC. The invoice enclosed to the goods certifies that VAT has been paid. VAT must be indicated at the order date and validated by our commercial services. The Customer is aware and accepts that an order whose VAT registration number has not been indicated or validated by our trade services will be invoiced VAT included.
2.2 Rate
The VAT rate applied depends on the country of delivery of the goods.
2.3 VAT refund
The customers who have omitted to fill the VAT number in the order form and already have got the invoice, can obtain a VAT refund by contacting the national authorities. MICROTECH RETAIL ITALIA can not longer change the invoices.
3.0 Order
3.1 To place an order
When the customer places an order through the website, he fills in a form with his personal data. We suggest him to read the form before validating the order. Company MICROTECH RETAIL ITALIA is not responsible for mailing and parcel delivery to wrong addresses due to mistakes in filling the form.
3.2 Confirmation
As order confirmation is sent to the customer an automatic e-mail subject to the validity of the electronic address stated in the order form.
3.3 Cancellation
3.3.1 The Customer may cancel the order at any time except when the invoice has been issued and the order has already been dispatched. In that case, if the customer do not want the items any more, he / she must accept the parcel and send it back at his expense after getting in touch with MICROTECH RETAIL ITALIA. If the customer has placed an order through the MICROTECH RETAIL ITALIA website at the https://microtech.store/?lang=en, he can cancel the order by phone, fax or email. If the Customer decides to refuse the package, then Microtech will deduct an amount equal to 2.5 times the shipping costs from the refund.
3.3.2 The cancellation of an order paid in advance by bank transfer or PayPal.
B – Payment by PayPal
If the Customer cancels an order paid in advance with PayPal, in full or in part, no matter if the items are in stock at the time of the cancellation or not, within 7 days will be carried out a refund corresponding to the amount paid through the Customer’s PayPal account.
3.4 Products availability
Our products and their prices are valid as long as they are visible on the site, among the available products. The customer can get more information by phone, email or fax. Should the product not be available, this information is published on our site. The Customer can read the following information: “Product available in stock”, “Product available if ordered in advance”, “Order on Request”, “Out of Production”. If the company MICROTECH RETAIL ITALIA is not able to provide a product, it will notify the customer by email. The Customer will be able to choose whether to cancel the order or accept the proposal of an alternative product. In any case, no penalty will be applied for canceling the order.
Promotional offers are meant until stocks last.

4.0 Payment
In the case of payment by card, the amount will be charged to the Customer’s account as soon as the transaction is complete. In case of partial shipment of the order, only the amount of the items shipped and the shipping costs will be charged. MICROTECH RETAIL ITALIA reserves the right to cancel an order.
4.1 Mode of payment
Customer can pay as follows:
4.1.1 Credit Card / Debit Card / Prepaid Card (Mastercard, Visa)
4.1.2 Bank transfer.
4.1.3 PayPal.
Payments by PayPal will be processed in Euros and the applicable conversion rate will be charged to the customer.
Important Note: Depending on the MasterCard and Visa regulations, the user is obliged to choose whether to use the credit card or PayPal conversion process. If the Customer chooses PayPal Currency Conversion, he / she can not hold MasterCard or Visa responsible of any conversion issues. If the Customer chooses MasterCard or Visa, he / she can hold PayPal responsible of any conversion issues. PayPal does not carry out any currency brokerage and therefore it has to buy foreign currencies from its own bank. PayPal receives a wholesale exchange rate from its bank (twice a day) and adds a further 2.5% margin to determine the exchange rate applied to transactions where a currency conversion is expected.
4.1.5 Cash payment to the courier (€999.99 VAT inclusive, max)
4.2 Non – payment
Company MICROTECH RETAIL ITALIA reserves the right to refuse to deliver or to process an order made by a customer, who has not fully or partially made the payment of a previous order or if a dispute with him is under way.
4.3 Anti-fraud controls
The information concerning the customer’s order is subject to additional controls to prevent financial frauds (through credit card, PayPal, and other payment methods). MICROTECH RETAIL ITALIA reserves the right to request further documentation (photocopy of identity card, credit card copy, domicile, …) for orders made by credit card or through PayPal to simplify any security checks. Shouldn’t such documentation be transmitted, the transaction execution and analysis will be hindered. The non-payment due to fraudulent use of a credit card, a PayPal account, or other payment method will drive to the registration of the non-paid order in an archive. An irregular statement or an anomaly may be subject to a specific treatment. Subject to the law 196/2003 and subsequent amendments and additions (Privacy Code), the Customer has at any time a right of access, rectification and opposition of all of his / her personal data by writing a letter and providing proof of his identity to the Company MICROTECH RETAIL ITALIA. In addition, Company MICROTECH RETAIL ITALIA may require the Customer to provide the necessary documents for processing the order, such as domicile, identity card, etc.
4.4 Reserve of property
Company MICROTECH RETAIL ITALIA remains the owner of the goods until the full payment by the Customer. These provisions do not hinder, after the delivery of the goods, the transfer to the Customer of the risks of loss or deterioration of assets subject to ownership, as well as the damages that may be caused.
4.5 If it is matter of a MICROTECH RETAIL ITALIA customer, the payment is settled in compliance with the terms agreed with the customer service. Any payment delay compared to the terms will result in a 2% commission per month, calculated on a daily basis.
5.0 Invoice
The order form the customer has filled in goes no for invoice. Whatever the order and payment arrangements may be, Customer receives the invoice inside the parcel on delivery. The company MICROTECH RETAIL ITALIA has a digital copy of every invoice.
6.0 Time
6.1 Management time
The orders placed through Internet are processed according to the time of arrival, from Monday to Friday in the office hours, excluding the public holidays of the Italian calendar. Order processing times vary depending on the payment method chosen (for example, the customer must keep count of the banking transfer time), availability of stock, and proceedings in force in the company. The difference in times can vary from minutes to days.
6.2 Shipping times
The times are provided by the courier. They are communicated to the Customer as an indication, on working days, and also depend on , if the address provided by the Customer is correct and if he is available on the delivery day. Therefore, company MICROTECH RETAIL ITALIA does not take any responsibility, if the courier does not comply with the times agreed. MICROTECH RETAIL ITALIA takes any responsibility for delays in delivery due to a wrong address or in case of strike or any other event of force majeure that slows or blocks the delivery of a parcel.
7.0 Shipment
7.1 Package
The products to be shipped are packaged in compliance with the relevant regulations.
7.2 Confirmation
If the customer has placed the order through the Internet website, he receives an automatic confirmation of the parcel delivery, provided that the e-mail address indicated in the order form is correct.
7.3 How to track a shipment
The waybill number will be available at the end of the day clicking on the tracking link related to the customer’s order. Thanks to this number the customer can track his parcel in the courier’s website.
For the tracking of the parcel only the courier will be liable. MICROTECH RETAIL ITALIA takes any responsibility for errors that may appear on the courier’s website or bugs that could hamper the tracking of the parcel.
8.0 Returns and right of withdrawal
The Customer may withdraw from the purchase contract for any reason, without giving reasons and without any penalty, within 14 working days from the date of receipt of the products.
The goods must be returned intact, complete with all its parts and in the original packaging, without any signs of wear or dirt, in compliance with the following conditions:
- the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (eg accessories);
- for the withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manual, cables)
- the shipping costs (and any customs fees, if any) for the return of the goods will be the sole responsibility of the Customer.
- the shipment, up to the certificate of receipt in the warehouse indicated by Microtech, is under the complete responsibility of the customer;
- in the event of damage to the goods during transport, Microtech will notify the Customer, to allow him to promptly file a complaint against the courier chosen by him and obtain the relative reimbursement from the latter;
- Microtech will not be liable in any way for damage, theft or loss occurring during or in any case depending on the return shipment.
Microtech will reimburse the Customer the full amount already paid, net of any additional shipping costs within 14 (fourteen) days of withdrawal, by means of a reversal of the amount charged, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a consequence of this refund. Microtech may suspend the refund until the returned product is received or until the Customer proves that he has correctly returned the product.
In any case, the Customer will lose the right of withdrawal in cases where Microtech ascertains that:
- the returned product and / or its accessories, and / or its packaging are not intact;
- the product is missing its external packaging and / or original internal packaging;
- the product is missing its integral elements and / or accessories (eg cables, battery chargers, manuals, etc.).
In case of forfeiture of the right of withdrawal, Microtech will return the purchased product to the sender, charging the shipping costs to the sender and, if already reimbursed, the price of the product.
